1 About these terms

These Terms and Conditions govern your use of Trail Navigator, provided by E. Fagerman Apps & Stuff AB, Sweden. Contact us at erik.fagerman@appsandstuff.se. The app provides navigation tools and, where available, Ride Groups and Alerts.

By using Trail Navigator, you agree to these terms. The applicable App Store licence terms also apply to the app. Our Privacy Policy explains how personal data is processed and is available at https://www.trailnavigator.app/privacy_policy.html. Nothing in these terms limits consumer rights that cannot legally be excluded.

2 Safe use of navigation

Maps, routes, positions and other information may be inaccurate, incomplete or out of date. A displayed route does not establish a legal right of access or guarantee that a road or trail is open, suitable or safe for you or your vehicle.

Follow local laws, signs, access restrictions and current conditions. Use your judgement and stop safely before operating the app. Plan for loss of coverage, battery power or GPS reception, and carry suitable backup navigation when needed. Trail Navigator does not replace your responsibility for decisions while riding or travelling.

3 Alerts and emergencies

Alerts are messages shared within a Ride Group. Labels such as Emergency or Assistance describe the message to group members. Trail Navigator is not an emergency response or rescue service, and we do not monitor Alerts.

Sending an Alert does not contact emergency services or automatically call or notify a saved emergency contact. It does not guarantee that another member receives, sees, acknowledges or responds to it. The app does not provide guaranteed push delivery. Network coverage, device settings, app state and service availability can affect delivery and visibility.

In an emergency, call 112 or the appropriate local emergency number directly and use other available ways to obtain help. Do not rely on an Alert as your only way to request assistance. Shared locations may be delayed or inaccurate, and Alerts may expire.

4 Accounts and group sharing

Group features require a supported signed-in account. Buying an App Store subscription and signing in to a Trail Navigator account are separate actions. Keep access to your Apple account secure and use accurate profile information.

Groups remain in place between rides. Other members may access information you share with the group even when they are not riding or have another group selected. Your shared information may include your name, initials, location, Alerts and optional phone and emergency contact details. Review the Privacy Policy and share only with people you trust.

Protect invitation links, which may allow recipients to join while valid. Group owners can manage membership and delete groups. You can leave a group. A member’s departure does not remove copies other members have independently saved.

Only add another person as an emergency contact after informing them about the sharing and obtaining their agreement. Keep their details current. The app does not undertake to contact that person on your behalf.

One phone publishes your account’s live group position at a time. When changing phones, use the app’s control to move sharing and check the displayed status. Pause sharing when you no longer want to publish your location. Cancel an active Alert separately when appropriate.

5 Subscriptions and payments

Certain features require a paid subscription. The App Store purchase screen states the price, billing period, any trial and renewal conditions before you confirm the purchase. Payments and subscription management are handled by Apple.

A subscription renews according to the terms shown at purchase unless cancelled through Apple. Manage or cancel it in your Apple account’s subscription settings. For purchase restoration, use the Apple account associated with the subscription; this may differ from the account used for Sign in with Apple.

Deleting the app or your Trail Navigator account does not cancel the subscription. Cancellation normally stops future renewal, with access continuing for the remaining paid period subject to Apple’s applicable terms. Refund and withdrawal requests follow Apple’s process and applicable consumer law; these terms do not remove any statutory entitlement.

Existing account and group administration, including leaving groups and requesting account deletion, remains available without an active subscription. Access to paid navigation or sharing features depends on the subscription and the offer shown in the app.

6 Your GPX files and other content

You retain your rights in the GPX files and other content you provide. Use content only when you have the necessary rights and permissions. You permit us and our service providers to process content as needed to provide the features you request, as explained in the Privacy Policy.

In this release, the GPX library is stored locally on your device and is not synchronised to Firebase. Signing in or purchasing a subscription does not create a cloud backup of that library. Keep copies of routes you want to retain and use available export or device backup options before changing or resetting your phone.

Online navigation and map services may send relevant coordinates, search terms or route geometry to Mapbox. Group information and Alerts are processed on the server and shared with the relevant members.

7 Acceptable use and intellectual property

Use the app lawfully. Do not attempt to bypass access controls, access another person’s account without permission, misuse invitation links, disrupt the service or send deliberately false emergency Alerts. Do not use another person’s location or contact information in a way that violates their rights.

The app software, branding and service materials belong to us or our licensors. Your right to use them is limited to the licence provided with the app. Restrictions on copying, modification or reverse engineering apply only to the extent permitted by law and do not restrict rights granted by applicable open source licences.

8 Service changes and account deletion

Features may depend on iOS, Apple, Mapbox, Firebase, internet access and compatible app versions. We may provide updates to maintain security, compatibility and functionality. Install necessary updates to keep using supported features.

We may change the service for justified reasons such as security, legal requirements or technical changes. For material changes affecting a paid service, we will provide the notice and any remedies required by applicable law. We do not remove your mandatory rights concerning conformity, updates, termination or refunds.

We may restrict access where reasonably necessary to address unlawful use, a serious breach of these terms or a security threat. Where appropriate and legally permitted, we will explain the reason and provide a way to contact us.

You may request account deletion in the app or by email. Cleanup runs in the background and may take time if interrupted. Groups you own are deleted with your account unless you transfer ownership first. This does not cancel your Apple subscription. The Privacy Policy explains data retention and deletion.

9 Liability and your legal rights

We are responsible for providing the service in accordance with these terms and applicable law. Service availability and navigation or Alert information cannot be guaranteed in all conditions. To the extent permitted by law, we are not responsible for losses caused by your unlawful use or circumstances outside our reasonable control.

Nothing excludes or limits liability where that is not legally permitted, including liability for intentional misconduct, gross negligence or personal injury where applicable law prevents limitation. Your mandatory rights concerning defective digital services and available remedies remain unaffected.

Swedish law governs these terms, without depriving consumers of mandatory protections under the law of their country of habitual residence. You may bring a claim in any court available to you under applicable consumer law. Contact us first if you would like help resolving a problem.

10 Eligibility and updates to these terms

Trail Navigator is not intended for children under 13. If you are under the age required to enter this agreement or make purchases where you live, involve a parent or legal guardian as required by law. App access does not establish eligibility to operate a vehicle.

We may update these terms for changes to the service or applicable requirements. The updated version will show its date. We will give notice of material changes and obtain agreement where required by law. Changes do not remove rights you already have concerning purchases or earlier events.
